In short
- The Android app's writing tools are free. Paid plans add sync, the web app, Tavora AI and online PDF tools.
- Subscriptions renew automatically until you cancel, and you can cancel at any time.
- Your notes are yours. We use them only to run the Service for you.
- AI requests go to third-party providers, and some of them may use requests to train their models.
- Anyone can report a shared note, folder or link, and a person reviews every report.
- New Mexico law applies, without taking away the rights you have as a consumer.
This summary is here to help. The full text below is what applies.
1. The agreement
These Terms of Service ("Terms") are an agreement between you and Tarnivo Labs LLC ("we", "us"). They cover Tavora Notes: the Android app, the web app at tavoranotes.com, this website, and the services behind them (together, the "Service").
By creating an account, starting a trial or a subscription, or otherwise using the Service, you agree to these Terms and to the policies they refer to: the Privacy Policy, the Acceptable Use Policy, the Refund and Cancellation Policy and AI and Your Data. If you do not agree, do not use the Service.
2. Who can use the Service
You must be at least 13 years old, or older if the law where you live sets a higher age for using online services without a parent's consent. If you are under the age of majority where you live, a parent or guardian must agree to these Terms for you and is responsible for any purchase.
You may not use the Service if the law forbids it, including the sanctions and export laws of the United States.
3. Your account
The Android app works without an account. Cloud sync, the web app, sharing, Tavora AI and the online PDF tools need one. You can sign up with an email address and a password, or with Google.
- Give accurate information and keep your email address up to date; we use it to reach you.
- Keep your password to yourself. You are responsible for what happens under your account.
- An account is for one person. Do not share it or sell it.
- Tell us at support@tavoranotes.com straight away if you think someone else has access to your account.
4. The Service
The writing tools of the Android app are free. Paid plans add features that run on our servers: cloud sync and storage, the web app, Tavora AI and the online PDF tools. What each plan includes, and its limits (cloud storage, synced notes, new files and downloads each month, the largest file, online PDF jobs and AI), is shown on the pricing page and in the app. Monthly allowances and limits start again each month on the date and time your plan started (for a subscription, its renewal date). When you reach one, the feature waits until then; nothing you have stored is removed.
The Android app is currently offered as an early-access release. Early-access and beta features may change, may have bugs, and are provided as they are.
5. Plans, payment and renewal
Paid plans (Plus, Pro and Premium) are subscriptions billed monthly or yearly; Plus is offered only in some countries. Prices are shown before you buy, in US dollars or in your local currency. Outside the United States and Canada the price shown includes tax; in the United States and Canada, sales tax is added at checkout.
- Where you buy. On this website, plans are sold through our payment processor's checkout, and the payment processor is the reseller and merchant of record for the purchase. It takes the payment, works out and pays any sales tax, VAT or GST, sends your receipts and handles payment questions, and its terms apply to the payment. We never receive your full card number, and we remain responsible for the Service itself. In the Android app, purchases are made through Google Play, and Google Play's terms apply to that payment. If we offer an app for Apple devices, purchases in it are made through Apple, and Apple's terms apply to them.
- One place at a time. A subscription belongs to the place you bought it, and cancelling it there does not cancel one bought somewhere else. If you pay in more than one place, your account gets the highest plan you pay for, and each subscription is charged until you cancel it where you bought it.
- Automatic renewal. Your subscription renews automatically at the end of each billing period, at the price then in effect, and your payment method is charged, until you cancel. By subscribing you authorise these recurring charges.
- Cancelling. You can cancel at any time: on this website from your account, or in Google Play or Apple's App Store for a subscription bought there. Cancelling stops the next renewal; your plan stays active until the end of the period you have paid for.
- Price changes. We will tell you at least 30 days before a new price applies to your subscription. The new price starts at your next renewal after that notice, and you can cancel before then.
- Changing plans. Moving to a higher plan takes effect straight away, and any price difference is shown before you confirm. Moving to a lower plan takes effect at your next renewal and never deletes anything you have stored. If your synced files are larger than the new plan's storage, new uploads wait until there is room.
- Failed payments. If a renewal payment fails, we or the store may try again. If it still fails, your account may move to the Free plan.
- When a plan ends. When a paid plan or the trial ends, cloud sync stops. Your synced content stays readable in the web app for 30 days, and you can download it, before it is deleted from our servers, as the Privacy Policy describes. Notes on your devices are not affected.
- Refunded or disputed payments. When a payment is refunded in full, or disputed with your bank, the subscription it paid for ends, so you are not charged again.
- Allowances. Your plan's AI allowance, generated images and online PDF tool jobs are monthly allowances. They start again each month on the date and time your plan started (for a subscription, its renewal date). Early access's allowance covers its 30 days. Allowances do not roll over and have no cash value. The size of the AI allowance depends on your plan and on the country you buy it in. It is the same whether you pay monthly or yearly, on this website or in the app, and the apps show how much of it is left. In the first 48 hours after the first payment of a new Google Play subscription, only part of that period's AI allowance can be used; the rest opens when the 48 hours are up.
6. Free trial
The Android app may offer a 7-day free trial of Pro through Google Play, once per Google account. Google Play asks for a payment method when you start it. The trial has Pro's features, but AI may be limited or not included.
Unless you cancel in Google Play before the trial ends, Pro starts when it ends and is charged monthly at the price shown when you started. If you cancel during the trial, you are not charged. You can also start Pro at any time during the trial; it is charged then. This website does not offer trials, and we may change or stop offering them to new users.
7. Refunds
Refunds are covered by the Refund and Cancellation Policy. A plan bought on this website starts as soon as you pay, at your request, and once you have used it, payments for that period are not refunded, except as that policy says. Purchases made through Google Play are refunded under Google Play's policies. Nothing in these Terms takes away a right to a refund that the law gives you.
8. Your content
Your notes, handwriting, drawings, recordings, documents and anything else you put into the Service ("your content") remain yours. We claim no ownership of them.
You give us a limited licence to host, store, copy, process, transmit and display your content only as needed to run the Service for you: to sync it between your devices, to show it to you in the web app and to the people you share it with, to back it up, and to process it when you ask, for example when you send a document to a PDF tool or a question to Tavora AI. This licence ends when your content is deleted from our systems.
You are responsible for your content and must have the right to use it. We do not use your content for advertising, and we look at it only when you ask us to (for example in a support request), when a note you shared is reported to us, when needed to keep the Service secure, to enforce these Terms, or when the law requires it. The apps also record which features are used, never your content, as the Privacy Policy describes.
9. Sharing notes
On a paid plan or the free trial, you can share a note or a whole folder with people you invite by email, who can read it or, if you let them, edit it. A shared folder gives them every note in it and in its subfolders, including notes you add later, until you take a note out of the folder or stop sharing it. You can also make a read-only link to a note, which anyone who has it can open, together with the files attached to the note. A link works for 30 days unless you choose another period, and you can turn it off at any time.
Share only with people you trust: anyone who can read a note can copy it, and anyone who has a link can pass it on. What others add to a note you shared becomes part of your note, and you are responsible for what you share.
Anyone you share with, anyone who shares with you, and anyone who opens a link can report a shared note, folder or person to us. With an account, you can also block a person: blocking takes both people out of each other's shared notes and folders and stops invitations between them; the other person is not told. When something is reported, we receive a copy of its title and the start of its text so a person can review it, and we may stop the sharing, remove content, or suspend accounts under the Acceptable Use Policy.
10. Tavora AI
Tavora AI is optional and runs only when you ask it something. When you do, the content of that request (your question, the part of your notebook you chose, and anything you attach) is sent to third-party AI providers to produce the answer.
Some of our AI providers may use the requests they receive to train and improve their AI models. Do not put passwords, identity or payment numbers, health information or other people's confidential information into an AI request. Notes you never send to Tavora AI are not shared with any AI provider. AI and Your Data explains what a request contains and what we keep.
AI output can be wrong, incomplete or out of date, and similar requests can produce similar output for other people. It is a study and drafting aid, not professional advice: check anything important, and do not rely on it for medical, legal, financial or safety decisions. As between you and us, you may use the output you receive, subject to these Terms and the law.
We may change the AI providers and models behind Tavora AI, and we may apply fair limits to keep it available to everyone.
11. Acceptable use
You must follow the Acceptable Use Policy. In short: do not break the law, harm others, infringe anyone's rights, or attack, overload or misuse the Service or its AI. We may remove content, limit features, or suspend or close an account that breaks it.
12. Copyright complaints
If you believe something shared through the Service infringes your copyright, use Report on the page where you see it, or write to support@tavoranotes.com with "Copyright" in the subject. Include:
- your name, postal address, phone number and email address, and your physical or electronic signature;
- the work you believe is infringed;
- the material you believe infringes it, with its link or enough detail for us to find it;
- a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for the owner.
We may stop sharing or remove the material, and we tell the person who shared it. If they believe it was removed by mistake or misidentification, they can send us a counter-notice with their name, postal address, phone number and signature, the material and where it was, a statement under penalty of perjury that they believe it was removed by mistake or misidentification, and their consent to the jurisdiction of the federal court for their address (or, outside the United States, any court where we may be found) and to accept service from the person who complained. We forward it to the person who complained; unless they tell us within 10 business days that they have gone to court, the material may be shared again.
The person who complained and the person who shared may receive each other's names and contact details, as this process requires. Knowingly false notices or counter-notices can make the sender liable for damages. We close the accounts of people who repeatedly infringe. Our Copyright (DMCA) Policy has the full process and our designated agent's details.
13. Our software and brand
The Service, its software, design and the Tavora Notes name and logo belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the apps under these Terms. You may not copy, modify, resell or reverse-engineer the Service, except where the law allows it despite this restriction.
Some parts of the apps are open-source software, used under their own licences. If you send us feedback or ideas, we may use them without owing you anything.
14. Other companies' services
The Service works with services run by other companies, such as Google sign-in, Google Play, our payment processor and our AI providers. Their own terms apply to your use of them, and we are not responsible for them.
15. Changes and availability
We work to keep the Service running, but we do not promise that it will always be available or free of errors. We may add, change or remove features.
If we remove or materially reduce a feature of a paid plan during a period you have paid for, we will tell you first, and you may cancel and receive a refund for the unused part of that period. If we stop offering the Service, we will give at least 30 days' notice where we can and refund any unused prepaid period.
16. Ending the agreement
You can stop using the Service at any time, and delete your account from Settings in the Android app or the web app, or by writing to us (how to delete your account). Deleting the account also deletes your synced content from our servers, as the Privacy Policy describes, and cancels a subscription bought on this website. Cancel a subscription bought through Google Play or Apple in that store first: deleting the account may not stop the store from renewing it.
We may suspend or close your account if you seriously or repeatedly break these Terms, if we must by law, or to protect other users or the Service. We tell you what we did, why, and how to ask us to look at it again, unless the law or someone's safety prevents it. Notes stored only on your device are not affected.
Sections that by their nature should continue after the agreement ends, such as those on liability, do.
17. Disclaimers
To the fullest extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Keep your own copies of anything you cannot afford to lose.
18. Limitation of liability
To the fullest extent the law allows, Tarnivo Labs LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to the Service, even if we were told they were possible.
To the same extent, our total liability for all claims relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim arose, or US$50.
These limits do not apply to liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence, and they do not affect the rights you have as a consumer.
19. Responsibility for claims
If you use the Service for business, or where the law allows it, you agree to cover our reasonable costs of claims brought by others that arise from your content or from your breach of these Terms or of the law.
20. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally will be decided by the state or federal courts located in Bernalillo County, New Mexico, and you and we agree to their jurisdiction.
Before starting a claim, please write to support@tavoranotes.com and give us 30 days to try to resolve it. Either of us may still bring a claim in a small-claims court that has jurisdiction.
If you are a consumer living outside the United States, you keep the protection of the mandatory laws of your country, and you may bring a claim in the courts where you live.
21. Changes to these Terms
We may update these Terms. If a change matters, we will tell you by email or in the app at least 30 days before it takes effect, unless it is needed sooner for legal or security reasons. If you do not agree to the new Terms, stop using the Service and cancel any subscription before they take effect. The date at the top shows the current version.
22. General
- These Terms and the policies they refer to are the whole agreement between you and us about the Service.
- If a part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer these Terms to someone else. We may transfer them as part of a merger, acquisition or sale of our business, and will tell you if we do.
- We are not responsible for delays or failures caused by events beyond our reasonable control.
- We may send notices to the email address on your account. Send notices to us at support@tavoranotes.com.
- If these Terms are translated, the English version applies.
